problem resolved. just figured out that security plugin was having conflict with theme, disabled it and now no issues, great theme guys!! loving it already

ok got it.. i have to go to /plugins/dirtysuds-kill-howdy and delete and add… simple and works with wordpress 3.5 ?? thanks ??
