Thank you for your review.In 2021, after consulting with our legal team and with our users and open source collaborators in South Africa, we implemented the POPIA legislation. This means that we created South Africa as a new region within our Privacy Suite, showing a specific cookie banner and?cookie policy?only to people that live in South Africa. That cookie banner asks for consent before first and third-party analytics?cookies?are set.?
We have updated the wizards that create your privacy statement, processing agreements, and data leak reports. They now contain references to the wording and definitions of POPIA. And of course, we modelled it so they contain the latest rights and obligations following POPIA and the guidelines from the Information Regulator South Africa.? The Protection Of Personal Information Act also requires that you as a website owner must search for consent from a parent or guardian if you wish to collect?personal information?from a child. So as a bonus, we added a?privacy statement for children.?In your review, you asked the question of whether a website should need a cookie banner. Do you have reason to believe that they are wrong?Now with regards to the list of other popia requirements. Section 18 of POPIA states that a responsible party must take reasonably practicable steps to ensure that a data subject is aware of how an organization will process their personal information. The twelve disclosures that are required by POPIA are actually all part of the documents Complianz generates. On top of that section 18(h) of POPIA requires you to inform a data subject of “any further information” relevant to your organization’s processing of personal information. Therefore we also included seven optional disclosures. Are there any specific requirements that you are missing?

Just wanted to let you know that our legal team always stays in contact with Data Protection Authorities around the world when it comes to the implementation or enforcement of new guidelines and laws.
We know that the Italian DPA uses the two categories “Technical” and “Profiling” as identifiers in their 2021 guideline. The description of what they consider to be technical is indeed the same as the description Complianz uses under “Functional” in the banner and the cookie policy. The way we implemented this is actually allowed by the Italian DPA because according to the DPA there is no universally accepted system for semantic coding of cookies and other tracking tools.
According to the Italian DPA you should therefore disclose the used criteria of the identifiers (Complianz does that in the banner), and you should consider placing those criteria in your cookie policy (Complianz already does that) or privacy statement. These criteria may also be communicated to the Authority upon request as a tool to support any investigative activities that will be undertaken with regard to the issues in question.

The widget itself does not seems to place or read cookies, but it does send the IP address of your visitors to the Windfinder company where they delete it after 7 days. They claim they do that for “technical reasons” and they advise to use the following text in your privacy statement:On this website the weather widget of Windfinder.com GmbH & Co.KG is integrated. Your IP address will be transmitted to Windfinder.com GmbH & Co.KG to display the weather data. Further personal data will not be transmitted. Your IP address will be logged by Windfinder.com GmbH & Co.KG for technical reasons and deleted after 7 days.
Personally, as a lawyer, I have my doubts about why they feel it is necessary to store all these IP addresses for a whole week. But if you would agree with that “technical reasons” explanation of Windfinder, it means that the reading and storing of the IP address by a German company can be considered “Functional” and therefore consent, blocking and a placeholder are not needed.
With regards to the placeholder text per script question: With “consent per service” enabled, the default text does dynamically ask for consent for a specific service. Click ‘I agree’ to enable {service}
I am not sure if this is also the case with services that are not integrated into Complianz. @jarnovos may know the answer to that.FYI: the weather widget from Windfinder actually does place third-party cookies when used inside an iFrame. It places and reads the _GA and the _GA* cookies for the purpose of “statistics”.
