It works fine, but there’s a side effect. The user can now see also the private post of other users (which it shouldn’t be in the scope of a private post).
Actually what is strange to me is that even without any capability change the user (subscriber) can read his private posts and can see them listed in a category. So why he shouldn’t get them by your query?
