    upgrading my theme doesnt help it seems..

    any thoughts?

    I think you might have outdated WP eCommerce theme files in your active theme folder.

    This would have to be wpsc-single_product.php right? I will compare it to the file in the plugin directory 3.9.1

    Yeah.
    Compare with the one under wpsc-components/theme-engine-v1/templates i believe

    Just did, could it be following line hereunder missing? Or can you tell me what code does the validation?

    In the current status a error message is returned but still the product gets added to the shopping cart.

    I`m not sure. i know there was a fix for that.
    What plugin version and gold cart do you have ?

    Plugin 3.9.1, dont think i use gold cart
