Uploaded Photos Results in No Photo in Gallery Message

The Gallery, a nextgen scroll gallery or with basic nextgen gallery, works well on the page until I uplad a photo using the public uploader. I have the uploaded photo needing approval prior to going live and when I uncheck exclude and save, the page now has a message that NO files are in the gallery that once had 22 photos.
First I tried the uploader in a scroll gallery, then I tried it in a basic next gen gallery, both times I had to reload the photos and create a new id for it to work again and each time the public uploader brought the no files message when opening the page.
