on 2 other sites i have a place in customize to put the privacy, etc pages. and i cant change the theme to add them

Have you tried creating a menu with those links (Appearance > Menus) and adding it to the theme using a Navigation Widget within the Footer Bar widget area (Appearance > Widgets)?

it was in the plugin, if activated it goes in customize

just one more thing and i shouldnt need anything. i cant get the background of the footer black. its like almost black but not. i tried site-footer
