This theme is totally made by cyberchimps to hack the servers of WP users. on download or local use it was fine, when we updated them after go live we found it started flooding our mail que every second, thousands of bounce backs. had to spend a day to track this and found issue with theme folders. there are several new files created after theme update and those had many curl post and get and malfunctions..they are pushing their to email list and content to our server and sending emails..

if anyone already hacked by it..remove the complete theme from server itself and clear mailque..check again after 1 day

The fact that your site was hacked does not implicate this theme in any way. And comments like:

are verging on legally libellous unless you have concrete evidence to back this claim up

Our themes are reviewed by the www.remarpro.com Theme Review Team and they would never allow any theme to be placed on the repository if it had any issues.
When a site is hacked the hacker sometimes places the files in different parts of the site. I imagine this is what happened in this case.
