Theme Distributed Without Permission

We have a website with a theme which has been originally created by my husband. However, we have recently found out that there have been people who are distributing our theme (they ripped it from our website) without permission. We have asked them to take it down but they have continued to ask others to message them if they are interested in getting the theme for free. Is this against the copyright law and what should we do?
