Terms and conditions validation

I am facing an issue regarding terms and conditions error.
When I add product into a cart and click on checkout button, it takes to checkout page. After that I click on “Login” link, it takes me to login form with “Purchase” button below terms and conditions checkbox.
When I click on “Purchase” button, WITHOUT checking box, my page gets redirect and shows error on redirected page.
BUT, I want error below login form. Please tell me the solution.
