This checkbox is not selected by default because your users should give their explicit content to receive emails from you by checking this box.

The behaviour can be changed with custom code, however, we do not recommend doing so since it may result in your subscribers not expecting to get subscribed and marking your confirmation emails/newsletters as spam.
