Opt-in checkbox for receiving e-mails, in shopping cart

Is EDD responsible for the language and checkbox my customers see when they are checking out and have entered their Paypal account info, which reads as follows?

“I’d like to receive special offers and promotional emails from (my business name here)…”

If so, when customers check this box, how am I alerted that they want to be e-mail subscribers?

Also, is it possible for me to change the language of this statement, or remove it completely? If so, how?
