NextGen Gallery – Validation Issue

I’m using the latest edition of WordPress and the Expound theme, i also have the very latest edition of NextGen installed.

I’m running into a validation issue, the plugin fails when set to Shutter 2, i switched to Highslide instead, it still fails but not so bad.

One issue which i just cannot see how to resolve. This is what the W3C Validation tester says.

No p element in scope but a p end tag seen.
/></div></div><div class=’ngg-clear’></div></div></p>

Can anyone help me out, i found an article in Google for these forums but unfortunately it was for an older edition of NextGen and i do not see the file to edit to remove this problem.
