New Users first comment not saved

I have been getting a number of complaints from people who are posting comments that aren’t showing up. Upon testing it appears that the first time someone tries to make a post nothing happens. Once they have been cookied down the user can post to their hearts content.
When i say nothing happens what I mean is that the page reloads with no new contents and there is nothing in the moderation cue.
I actually tested this myself so know it is happening. Clear your cookies and try to post a comment (if you want to test it use a comment that is obviously a test message so that I can delete it), the page will reload, and your details will be saved. After that you can post a comment and it will appear in the comment listing as if it was a normal post.
You can see my website here : https://www.binarymoon.co.uk – I’m using wordpress 1.513, and have the following spam plugins installed lr2Spam, SpamPop and that’s it ?? I also rename wp-comment-post to try and slow down those dastardly (normally I’d use a stronger word) spammers.
I’ve tried searching to see if anyone has had a similar problem but haven’t found anything. I did notice a cool little thing that checks to see if a comment is in moderation and if so add a saying so, which is now added.
