I would think that you should ask before jumping to conclusions.
If you read his post, he used it as an insperation, not a reference.
That zen garden theme is inspirational. How did they get that image of the girl with the Chinese “dream” character on her back to overlap the CSS, or is it just a photoshop mod of the header image?
I still have not been able to reach the author of the particular style of csszen garden in question but after talking with several people in #wordpress they feel I should re-release the theme, just with modified documentation, I may do that in the near future.

As far as both the themes are concerned, Hampsha and the Css Zen garden, they seem to waste a lot of space on either side of the border. It seems to make the page unnecessarily long if you type large posts.

Ok, the site is very similar, but if you look at the one in css garden, you’ll note the whole site is just one big image. the site here uses a lot more css to create the design. Although the CSSGarden site looks better, I’m sure this one would too if it was done in Photoshop completely.
He’s taken an existing idea and used CSS to recreate it – it’s a copy, when it comes down to it, but he’s done it better by sticking to CSS rather than loading up one big ass image.
I tend to disagree with your post Jinsan, yes it is one image, but one image well done, Ok it is 138 KB but I got cable and it loads extremly fast. A design is a design whether someone obtains the same look through a div or table it really does not matter what method is used. What matters is the way that he released it although it was his own that is offensive. Color schemes are widely copied whether someone uses pixie or any of the color scheme methods out there. Nobody owns Orange or Green last time I checked but the design is clearly not original at all.
no dawg, I completely agree with you it is a copy. I don’t want to say rip off, but those were the words that sprung to mind. I’m not saying he’s done a good thing, it’s bad, but he’s done it a different way. What you prefer is personal preference. I concur with yur comments tho
I believe that method has acknowledged the source and made efforts to contact the author, and added that when he has he will release the code assuming permission is given.
But he cannot get in touch – so his design languishes.
And if he never gets in contact, it’s right that it stays unreleased ?
Even though there will be a clear credit in the file ?C’mon, give the guy a break !

Okay. Can someone please explain, in very very simple terms, why when this CSS has all this in it, method cannot release it.
I am stumped at all this wierdness by so many people.

Since nearly the beginning, there have been people grabbing entire templates, graphics and all, and using them as the basis of their site; these I have politely requested the site owners to take down, and compliance has been prompt and agreeable.
The tricky part is when people want to use an individual .css file as a basis for their design, changing only images, perhaps with a new colour or font scheme. Obviously releasing the .css file under the Attribution-ShareAlike license from Creative Commons means that ita€?s open to interpretation; Ia€?ve tried to address this in the FAQ by adding a further layer of permissions on top of the CC license.
The idea is that you can feel free to steal bits and pieces, learn from, and generally plunder the CSS as long as you dona€?t approach it as a template. The line is fuzzy and vague, and ita€?s where most confusion springs from.

that would be great. The CC clearly stated that you should give the original coder credit for this piece (or any piece from css zen garden). It certainly doesnt help since your template look very much the same as the original one. But rest assure that its not your fault when you try to contact the original coder but he didnt reply :). And yes, i think its appropriate for you to release it, provided you have ask the author about it and put credit in the css and html source code.
Unless somebody else has a better solution, this is just my $0.02 ??

the template layout and color scheme is very close to the original. I would not say it is a complete rip off of the original. I would prefer ‘hampsha’ to have a different color scheme, navigation system and background so that it can further stand out as an individual theme, that is really inspired from CSS Zen Garden. If not, I feel it should be “based on CS Zen Garden”
