migration from joomla to wp

we paid a webdesigner to build a wordpress website for us. they built it with joomla instead. we asked for it to be wordpress, so they migrated the existing joomla into the twenty13 theme available in wp 3.6.1.
why is about a third of what i see on the dashboard of the free version of twenty13 no longer there in the paid for version? there are also no stats, no fallback template, and a lot of uneditable “stuff”, no drag&drop and edit&save options in places where the free version has them. the backend looks very different indeed from the clone i made with the free twenty13 version. also, the free twenty13 is fluid/mobile ready, and the migrated version is as static as joomla beez was/is– why would existing functionality from wordpress just get dropped (when it’s BETTER) during a migration? i mean, mobile-readiness ought to *clearly* be the preference– can a programmer not influence what functionality stays and what doesn’t?
the free twenty13 also has about 41 widgets to choose from, and now the version we paid for only has half of those. the webdesigner said those weren’t in the contract…..but wordpress gives them to you for FREE! i don’t understand. who would delete all the wonderful, cool, nifty things you can do now with menus etc in wp 3.6.1?? and how, and why?can someone clue me in what happened there? the webdesigner denies any wrongdoing– we are arguing we are missing basic/standard functionality. this is incredibly important to me because we paid a large amount of money and have a dysfunctional site. they claim we approved it as is– but it took us a week of trying stuff and more and more errors came up that are now filling an excel spreadsheet. we then had the idea to lay our website side-by-side with the free version, and it’s blatantly obvious that the free version can do more than the one we paid for. i’d say, a third of the functionality has simply gone missing. in the css there is still written that the template for the website is joomla beez (but it’s telling me the cms is wordpress). i’m confused and would like to understand what happened and how and what can (should?) be done.
