Malware Flag – false positive?

    Defender Pro has identified line 35 of flowpaper.php as a suspicious function:

              //unset magic quotes; otherwise, file contents will be modified
          if(version_compare(PHP_VERSION, '5.3.0', '<')){
		          set_magic_quotes_runtime(0);
		      }

    Presumably this is a false positive?
