sure, you can use position: fixed; instead of position: absolute;
Support in Internet Explorer is bad, but should work in IE8 and up.

in case of the example skin, set position to fixed where it says position: absolute on #cookie_opt_in_top_bar_container

you can do that in the file css/cls-style.css in the plugin folder,
or you can use the wordpress theme editor and add

#cookie_opt_in_top_bar_container {
position: fixed !important;
}

at the end of your style.css

should be enough to get it to stick.
