if (have_posts() and non existing url

hi,

i have a problem with if (have_posts() it doesnt display the usual
“Sorry, but you are looking for something that isn’t here.”

that is in the index.php but instead it shows my home page.
i use the default loop.

why does it get pass the if (have_posts() when the url does not exists?
