Filter widget visibility – possible only at bottom of category hierarchy?

I was wondering if someone might be able to help me with this one. We already have the Pro version for a customer’s site. They have one ‘Shop’ page that displays all of their shops’ products i.e. there are no sub-categories. The Pro filter plugin works great for this.
We’re looking to build another site for a different customer. They would like sub-categories for their products. What I am struggling to do is work out whether the plugin can hide the filter widget if no products with relevant product tags are displayed at the currently viewed level. What I mean is that on the new site they will have, for example, a sub-category structure like this:
Shop
– Computers
— LaptopsProducts will only appear in the bottom level category of each section. No products will appear in ‘Shop’ or ‘Computers’, only in ‘Laptops’. What I want to do is hide the filter so that it only appears on pages where products are displayed.
At the moment, I can only get it to appear everywhere or nowhere i.e. it is showing on the ‘Computers’ category page even though no products are in that category.
I have set up a product tag called ‘Dell’ and applied it to a test product in the ‘Laptops’ category. The filter is showing up in all categories though – the filter seems to be picking up products from sub-categories which I do not want it to.
Is there a setting to stop this so that it is only displayed on pages where relevant products are displayed?
