Exclude child_cat from archive & make form work outside loop

So what I want is.. To exclude any post in the child cat from the loop within archive.php, and the thing is.. This works on the index smoothly, but not on my archive.php

The codes are almost the same and both works like a charm, EXCEPT if I use the <form>/sorting outside the loop as of index.php it ignores it? it does not do this on index.php

Please help
