Don't want to be a theme hacker, but…

Our non-profit (https://wowinfo.org/new/) paid a woman on May 5th 2011 to change the theme, backup and update our www.remarpro.com site. In August 2011, after many phone calls and emails, we were finally able to see what she created. We’ve been trying to get her to put it up on the internet ever since and she will not respond to any of our calls or emails.

Due to the site being down, we haven’t been able to generate any additional/ new funds to support the nonprofit, and now we REALLY have no money. Can we take what she created (https://virtualservices4u.com/wow/) and have someone else, who is willing to donate their time, put it online? Is this considered copying/ stealing since we did pay for her services almost a year ago?
