Displays the comment form even comments are off

Hi,
I’m using the blog posts widget on a homepage (Nirvana Theme from cryout creations), where comments are deactivated – but the comment is still visible. Deactivating the Ultimate Addon Plugin let the comment form disappear as intended.
Anyone seen this behaviour too?
I could hide the comment form via CSS but there must be a better solution.
