Thank you for creating this wonderful and useful Plugin.

I’m struggling with some elements that are confusing me though.
I’m currently using version 4.6.2 and I would really appreciate some guidance please.

On a test site, I have WPBakery Page Builder, WordFence, Google Fonts (called in CSS with no cookies – but IP is transmitted), Google Maps (API v3 with no cookies – but IP is transmitted) and reCAPTCHA (does use cookies). There are no Ads or any marketing plugins. Non-Admin users are NOT permitted to login, and comments are disabled.

In the first part of the auto-generated Cookie Policy, three elements are first explained: After the introduction section (1.), we have the following sections:
    2. Cookies, 3. Scripts and 4. Web Beacons.

In a sub-heading (“4.1 Manage your consent settings”) under the main heading “4. Web Beacons”, there are two tick boxes. “Functional Cookies (which is always ticked), and one for Marketing.

Why are we talking about Cookies under Web Beacons? And why is there a “Marketing” tick box at all, given that there are no marketing cookies in the real sense of the word?

I wonder if “Manage your Consent Settings” should in fact be in its own section 5. rather than a subheading 4.1 under “Web Beacons”?

I also wonder if “Marketing” is in fact the wrong term, and in should simply be “All”, at least in my case? This element does not seem to be customisable. In my case “All” would encompass enabling scripts which might transmit the visitor’s IP (e.g. to Google for Maps API), and enabling reCAPTCHA cookies, as opposed to enabling true marketing cookies (I do not consider reCAPTCHA cookies to be marketing cookies)?

I hope I have expressed my confusion clearly, and have not made things even more confusing by providing too much or too little detail.

    Hi @farisr,

Thank you for reaching out with your questions. Regarding your questions about the order of the legal document, could you share your URL? You can do this privately under ‘the page I need help with’.

Normally there should be a separate paragraph called ‘Consent’. Under Consent should be the subheading ‘manage your consent settings’.

Regarding the categories of cookies, you can rename these under cookie banner settings and then the different tabs. I understand the thought that you don’t use Recaptcha (and it’s cookies) for marketing purposes. Though Recaptcha collects personal information that is being sent to the Google servers. This can’t be seen as functional, preferences or statistics. For more information about Recaptcha and the GDPR, please refer to this article.

While it is required to ask specific and informed consent, I would not advise renaming a category to ‘all cookies’.

I hope this helps. Please let us know if you have any further questions.

    Kind regards,
    Leon

Thanks Leon. URL added. There is no Consent section. I think you are right that this is why I’m confused on that element. I have updated it today and still the same.

I agree that reCAPTCHA cookies are not functional. However, they are definitely not Marketing either.

I see that I can modify the name if I choose to use Categories. I was using accept/reject. I think I can work with this. I will experiment. But I will leave it as for now so you can see the Consent section being missing.

@farisr I have set up some tests on our testing environments and managed to reproduce your issue.

We will create a fix for this issue this weak and release it with our next update. I will post a link to the fix here, so you don’t have to wait for the update.

    Our apologies for the inconvenience.

    Kind regards,

Thank you Leon. Your support is amazing and very much appreciated.

I wish all Plugin publishers were as good.

    Hello,

I too wonder why it’s called “marketing” for instance about re-captcha, I understand better. But for visitors it’s not the best thing to give consent…
So I’m waiting here too for a work around. Thanks !!

    Hi @lsphoto,

As you can read in our article about ReCaptcha, this service collects a lot of information, among which:

    • A complete snapshot of the user’s browser window at that moment in time will be captured, pixel by pixel (!)
    • Browser plugins
    • All cookies placed by Google over the last 6 months
    • Number of mouse clicks/touches you’ve made on that screen
    • CSS information for that page
    • Javascript objects
    • The date
    • The browser language
    • In this case it is irrelevant that you are using ReCaptcha only for spam protection. As the information is sent to the Google API and stored in third-party cookies it can not be seen as functional/strickly necessary. The collection and sharing of this data has a significant impact on the privacy of the website visitor and therefore requires consent.

As further explained in the article, this extensive collection of data does not fit in any other purpose, like functional or statistics. Rather to user tracking/marketing.

If you feel that another term describes the purpose better, you can change the description used on the cookie banner and manage consent section (in the Cookie Policy) via Complianz -> Cookie Banner, then navigate to the relevant tab (opt-in, opt-out, etc.).

I hope this clarifies. If you have any further questions feel free to respond or create a new ticket.

      Kind regards,
      Leon

Thank you for your quick reply !
I do understand and know google is a 24/7/007spy… Unfortunatly, it’s difficult to have a contact form without recaptcha. Reading “marketing” cookie -even it’s true for sure-, makes visitors hesitate (as I would myself) to agree and give consent. I’ve already think about how to call it another way, but didn’t find another word at the moment. It’s a pity…

    Thanks again ??

@lsphoto We are using honeypots on all forms on complianz.io with very little spam. We also describe some more privacy friendly alternatives in the mentioned article.

As some comments say, I doubt European Union would agree with a privacy policy of “pixel by pixel snapchot”. But you’re right, we have to get cookies consent.. You’re also right saying another word than “marketing” would perhaps be less ‘agressive’..
I don’t use form7 but ‘Formidable form’, I must learn more about honeypots !

    thanks for yout input !!

    EDIT :
you wrote “If you feel that another term describes the purpose better, you can change the description used on the cookie banner and manage consent section (in the Cookie Policy) via Complianz -> Cookie Banner, then navigate to the relevant tab (opt-in, opt-out, etc.).”

So I’ve changed the name with “follow” only, but it doesn’t change in your ‘Cookies Policy’ (that I’ve regenerated)… I’ll try to add a new page with your links, only modifying this on the recaptcha cookie, hope it will work.

Hi @lsphoto , Great to hear that your issue is resolved! Could you tell us what you think of the plugin or the support by casting your Review here? We’d love to hear your feedback!

    Hi @paapst ,

I’m not the author of this post, sorry, I had the same questions so I asked here…
It’s a great plugin, but I’ve other issues (opened another thread), so I’ll review it later ??
