Checkout “bill to different address” not mandatory. therefore no email address

It seems there was an update to woo commerce last week and now I am having issues with my checkout. Before the mailing address and billing address lines were all mandatory. Now the checkout page has an optional “Bill to a different address” button to click. IF it is clicked, the customer fills out this info, including their email address. If it is not clicked, there is no line to include the customer’s email address and therefore they aren’t receiving a confirmation email. I sell digital products so this is crucial they receive the confirmation email with a link to download the products. Any suggestions?? Thanks so much!
