    I moved overseas and became an expat for many reasons. I still go back to the United States of America, my homeland and a place like no other, to visit family and friends. At the moment, one of the things that might keep me or any other expat from moving back long term is something in the Affordable Care Act (a.k.a. Obamacare) called the individual mandate.

    For those of you that don’t know, the individual mandate is a part of the Affordable Care Act that requires Americans to purchase health insurance…..and if you don’t, there are dire consequences.<!–more–>

    If you don’t have health insurance, you will pay whichever of the two fees is higher. This gets paid when you file you annual tax return.

    The penalty gets paid for all household income above:

    • $10,150 for individuals
    • $20,300 for couples filing jointly in 2014, the most recent year available

    If you have coverage for part of the year, then you pay 1/12 less of the penalty for every month you have coverage.

    Of course, there are exemptions to the individual mandate like being too poor or if health insurance is too expensive relative to your income.

    FYI, expats are exempt (heh, heh, heh). ?Yes, that’s right! Living abroad exempts you from the individual mandate. However, you must meet one of these residency requirements:

    1) Be a bona fide resident of a foreign country (or countries) for the entire tax year (January 1st – December 31st) (Bona fide residence test)

    OR

    2) Be physically present in a foreign country (or countries) for at least 330 days of the entire tax year for whatever reason (Physical presence test)

    *Expats can claim this exemption when they file their tax return.

    The idea behind the individual mandate is that if you force younger healthier individuals (and poorer) into the insurance pool, health insurance will become cheaper for older (and wealthier) individuals and those with worse health conditions.

    If you are one of those younger, poorer individuals your insurance premiums go up because you are thrown into the same insurance pool as older and sicker individuals.

    If you have student loans, you are even worse off because the subsidies are in the form of tax credits (instead of cash) do not cover most Americans. If you pay little in taxes or not at all, these tax credits will not cover the insurance premiums.

    In order to qualify for a subsidy (tax credit), you have to make between 100% and 400% above the Federal Poverty Level (FPL).

    The subsidy is the difference between the cost of the Second Lowest Cost Silver Plan (SLCSP) and the health insurance cap that insurance companies can charge you (based on a percentage of you household income).

    For example: John Doe makes $40,000 a year. He is single. The Federal Poverty Line for him is $11,770 a year. That means that he makes 370% above the FPL. 9.66% of his household income is $3,864 or $322 a month, which would be the limit of what insurance companies would be able to charge him for the SLCSP. His subsidy would be the difference between the cost of the health insurance (any plan) minus $322 a month (his insurance cap) to cover the difference. If the SLCSP costs $500 a month, his subsidy would be:

    $500 (SLCPS) – $322 (Insurance cap) = $178 a month (subsidy) to spend on any health insurance plan

    *As you can see the subsidy does not cover other $322 a month ($3864 annually) for the insurance plan. That’s a lot of money for someone making $40,000 a year before taxes. Some insurance plans are more expensive than that.

    Overall, Obamacare is a good law. There are a lot of good things in it, but this is one area in dire need of reform.

    Expats are immune to the individual mandate?while living abroad and only temporarily?after?moving back to the United States.

    There are many possible solutions to this problem presented by the individual mandate. What do you think? How we fix this dilemma? Is the single payer system the answer?
