Can't seem to exclude draft posts

I have used Taxonomy Picker on a few websites… in combination with Formidable forms you can build websites way more complex than would otherwise be the case, so thank you! I have a problem that I have configured the widget to never show empty categories of post, but it doesn’t regard a category with a draft post as empty, so the option still shows up in the drop down selector for the search, and leads disappointingly to a nil result. I’d like to exclude draft posts.
I tried to use your provided category exclusion system as best as I understand it… I added a taxonomy called “hide” and added categories “yes” and “no”, then attempted to exclude the posts that were “yes” by configuring the widget. The option still shows up in the dropdowns! How do I get rid of those options?
