    Hi All, semi-copyright noob here and I couldn’t find anything through search.

    I want to design (I have a mock up already) a theme for a specific use and sell it as a premium theme. Do I have to build the html from scratch and convert? Or is it possible to “highjack” a current open source theme, make my significant alterations, and then sell it?

    Which leads to one final question, how can you determine which free themes on wordpress’ theme search are open source vs. free by privately copyrighted?

    All themes state their license in the style.css file and most are licensed under the GPL. Considering what you want to do, this is the most relevant part of the GPL:

    You must cause any work that you distribute or publish, that in whole or in part contains or is derived from the source or any part thereof, to be licensed as a whole at no charge to all third parties under the terms of this License.

    In other words, if you modify a GPL theme, you may modify and redistribute it, so long as it is also free and licensed under the GPL.

    Basically, if you want to sell a theme, you’ll have to build it from scratch.

    html and php is not copywritable in my mind. All themes use a loop and the same template tags, and so on. If you use your own graphics you can sell it as a premium theme.
