Able to add more listings than upload limit?

So I have noticed on one of my test accounts that it has a limit of 10 listings..I have set the recurring payment to 1 month cycles…What I have noticed is that this account has 8 listings already which I have previous uploaded for test…I just went to test something by uploading a listing in the account and on the remaining listing it is showing 10 listings remaining even though the account already has 8 uploaded and active.

I need the account holder to only be allowed the set limit of listings to what the package allows them, is this resetting their allowance each month or something and not counting previous live listings they have uploaded. Does their allowance reset each month regardless if they have previous listings live?
