How to make Form fields required to subscribe?

Can this plugin be forced to REQUIRE users to click an option (e.g. ‘I Agree’) before being able to click the submit/subscribe button? While having it pre-checked is okay, I’d still like it to NOT allow them to subscribe if they un-check it (for legal reasons).
