Theme Install / Disable Comments

Having a couple different problems:

The option to disable comments completely seems to be missing completely from my dashboard, can you not turn comments off with certain themes?

Also I’m trying to install a theme, I’ve purchased a couple now, and keep getting the same error message – after the upload reaches 100% I get taken to a page that just says “Are you sure you want to do that?” and no other options.
