Broken markup: Tags closing for headers below minimum

Thank you very much for this plugin. It directly addresses a need for our end users. Unfortunately due to the way they structured their historic content, we’ve run into a bug.
Plugin version 6.0.9 running on current WordPress.
Content header structure:
H2 1
H3 1.1 (optional, same issue if skipped)
H2 2
H3 2.1Simple TOC block settings: Minimum level including H3
Bug: The plugin closes the ul & li tags for the first H2 even though only the H3s are rendered. This causes the rest of the TOC content to render in a second ul outside of the simpletoc-list classed element. This breaks the styling & display.
Using the plugin settings minimum level including H2 renders them all properly. However the end users are adamant that only H3s belong in their TOC.
My hunch is that the method to close tags isn’t checking the minimum level to determine if the header was displayed in the first place.
Hoping you can look into and resolve that issue. Please let me know if the replication content structure & block settings do or don’t work for you!
