Yes, there are using a very old version of jQuery WayPoints.

If you could, you could reach out to them and ask if they have a method that can be used to detect their their theme. After a quick search I could not find anything. If I had that, I could detect the theme and basically break this feature in ezTOC so it does not conflict with Avada.
